How Much Does A Disability Lawyer Cost

Our Social Security disability attorneys don’t collect payment unless we win your case. We understand that individuals applying for Social Security benefits typically can’t afford to pay an attorney to help with their claim. That’s why at Hanson and Fisher there will never be any upfront costs to get the help you need to file a successful disability claim.

Instead, our Social Security disability lawyers work on a contingency basis. Whether your disability lawyer spends days or years working on your case, we won’t get paid unless you do.

When we do win your case, our contingency fees are limited to 25% of your backpay. Even then, the attorney’s fee may not exceed $6,000 (unless your case is appealed to the Appeals Council and/or federal court). And when it does reach that $6,000 cap, it means that the claimant is due benefits totaling at least $18,000, after covering the lawyer’s fee.

These limits on what a disability lawyer can charge for their services are built into disability law. In some specific instances, our lawyers may incur expenses while gathering evidence to win your case. Ordering additional medical testing and obtaining copies of your medical history are two common reasons for such fees. But most medical records can be obtained freely in today’s digital age. So in many SSDI and SSI benefits cases, our disability lawyers will only collect the standard contingency fee.

Calculating Disability Back Pay

Because the application process for disability benefits often takes months, the Social Security Administration (SSA) awards back pay after claims have been approved.

You become eligible for Social Security Disability Insurance (SSDI) benefits during the sixth full month after your established disability onset date (EOD). When your claim for SSDI benefits is approved, you can collect up to 12 months of SSDI back pay, beginning during the sixth month after your EOD.

You may also be eligible for SSI back pay. However, you can only receive SSI benefits beginning from the date you apply for benefits onward. Thus, you can only receive SSI back pay for the time in between filing for benefits and receiving them.
